Affiliate Agreement

This Affiliate Agreement (“Agreement”) sets the terms and conditions for participation in the affiliate program (“Program”) offered by Szymanski Media, LLC (“Company,” “we,” “us,” or “our”). By applying to or participating in the Program, you (“Affiliate,” “you,” or “your”) agree to the terms below.

1. Enrollment & Approval

Affiliates must submit an application to join the Program.
We reserve the right to approve or reject any application at our sole discretion.

Affiliates may not use misleading, fraudulent, or abusive methods to obtain referrals.
Self-referrals are strictly prohibited.

We may remove or suspend affiliates at any time for any reason, including policy violations.

2. Commission Structure

The standard commission rate is 40%, unless otherwise stated on a specific product page or in a written agreement with the Affiliate.

Commission rates may vary by product, promotional campaign, or individually negotiated terms.

3. How Commissions Are Earned

You earn commissions when a referred customer:

Uses your unique referral link to make a qualifying purchase, and
Keeps that purchase past the refund window.

Purchases refunded, disputed, canceled, or charged back do not qualify for commissions.

Commissions are tracked automatically by our platform using cookies and referral links.
We are not responsible for lost tracking due to customer browser settings, ad blockers, device switching, or link misplacement.

4. Refund Window & Approval Timing

Commissions are marked as “earned” only after the applicable refund period has fully expired.

Standard refund period: 30 days, unless otherwise stated.
Pre-sale refund policy: refunds may be requested only before the product is delivered. Once the product/content is delivered, all sales are final.

If a refund is issued before the refund window closes, the commission for that referral is voided.

5. Payout Schedule

Once commissions are marked as earned, they will be paid out according to our regular payout schedule, typically during the second week of each month.

Minimum payout thresholds may apply depending on payment processor settings.

Affiliates are responsible for ensuring payment details are accurate and up to date.
We are not liable for failed or delayed payments caused by incorrect or outdated information.

6. Restrictions on Promotion

Affiliates may NOT:

Use spam, unsolicited emails, or deceptive marketing.
Run paid ads targeting our brand names, product names, or trademarked keywords.
Create or promote fake discounts or misleading claims.
Misrepresent our products, our company, or your affiliation with us.
Impersonate the Company or claim to represent us.

Violation of these rules may result in immediate removal from the Program and forfeiture of unpaid commissions.

7. License to Use Creative Assets

We may provide promotional graphics, copy, or branding materials.
You are granted a limited, revocable license to use these assets solely for Program participation.

Do not modify logos or brand assets without permission.

8. Independent Contractor Relationship

Affiliates are independent contractors, not employees.
This Agreement does not create a partnership, joint venture, or agency relationship.

Affiliates are responsible for reporting and paying any applicable taxes on commissions earned.

9. Termination

We may terminate or modify the Program, commission rates, or this Agreement at any time.

If terminated, any earned-but-unpaid commissions will be paid according to the terms above, provided no violations occurred.

Affiliates may withdraw from the Program at any time by ceasing promotion and informing us.

10. Limitation of Liability

We make no guarantees regarding income or results.
We are not liable for:

Lost commissions due to tracking errors
Losses from promotional activities
Technical issues affecting referral tracking or payouts

Participation is at your own risk.

11. Changes to This Agreement

We may update these terms at any time.
Continued participation in the Program constitutes acceptance of the latest version.
